Terms and Conditions

 

  1. Introduction

1.1 These terms and conditions govern your use of the Portal ("the Portal") provided by Walsall Council ("the Authority"). By accessing and/or using the Portal, you (“You” and “Your”) agree to be bound by and subject to these terms and conditions (“the Conditions”) and any change to these Conditions.

1.2 The titles in these Conditions shall not limit or impact on the interpretation of the Conditions, or any part of these Conditions.

 

  1. Your Use of the Portal

2.1 You  shall use the Portal for lawful purposes only. You must not use the Portal in any way that breaches any applicable local, national, or international, law or regulation.

2.2 You must not use the Portal to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).

2.3 You must not  transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code, which is designed to adversely affect the operation of any computer software or hardware.

2.4 You must not attempt to rectify or permit any person (not authorised by the Authority) to rectify any fault or inaccuracy in the Portal.

2.5 You must not allow, or purport to allow, access to the Portal by any third party.

 

  1. Your Account

3.2 You are responsible for maintaining the confidentiality of your Account information, including Your password, and for all activities that occur under Your Account.

3.3 You agree to notify the Authority immediately of any unauthorised use of your Account or any other breach of security which may affect the Portal.

3.4 Your password should contain at least:

  • 10 characters long
  • 1 uppercase character
  • 1 lowercase character
  • 1 number
  • 1 special character ~`!@#$%^&*()-_+={}[]|\;:<>,./?"'

 

  1. Privacy and Data Protection

4.1 You will only use the portal to  enter information relevant to the specific case being actively worked.

4.2 All information entered into the Portal must remain confidential and must be treated as confidential by You at all times.

4.3 When You use the Portal You must adhere to all applicable current data protection laws and regulations, including (without limitation) the  UK General Data Protection Regulation, Retained Regulation (Regulation (EU) 2016/679) and/or EU General Data Protection Regulation (Regulation (EU) 2016/679), as applicable and the Data Protection Act 2018 (the “Data Protection Legislation”).

4.4 You must ensure that all information that you enter onto the Portal is reasonably necessary and relevant for the purposes for which it is being entered, up to date and factually accurate.

4.5 All forms completed through the Portal must be appropriate to the specific case for which information is being shared.

4.6 You must have a lawful basis to access, upload and/or share any personal data on the Portal and it is your responsibility to ensure any data usage is complaint with the Data Protection Legislation.

4.7  When using the Portal, You must ensure compliance with Your obligations as a data controller.

 

  1. Non-Compliance and Remedies

5.1 If You do not comply with these Conditions, the Authority may at any time take such action as it considers necessary and prudent (at its absolute discretion), including (without limitation) suspending and or cancelling your Account and/or your use of and/or access to the Portal in general.

5.2 The Authority reserves the right to cancel Your Account  at any time, without notice, if it has reason to suspect that Your use of the Portal is for fraudulent purposes, or for any other unlawful purpose or activity, or which is in any way in contravention of these Conditions, or if the Authority considers that Your use of the Portal is in any way improper or unacceptable.

5.3 The Authority may monitor Your use of the Portal to verify that You are complying with the requirements of these Conditions and are not accessing and using the Portal (or any information on it) for any purposes which are prohibited by these Conditions.

 

  1. Intellectual Property

6.1 The Authority owns or has the right to use all intellectual property rights in the Portal and its content, including but not limited to all text, graphics, logos, and software.

6.2 You shall not become entitled to any intellectual property rights in the Portal, or any information which is either on the Portal or referred to in the Portal, from time to time, by reason of Your use of the Portal, or having and using the Account.

6.3 You shall not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, store, or transmit any of the material on the Portal, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

 

  1. Exclusion and Limitation of Liability

7.2 To the fullest extent permissible by law, the Authority disclaims all warranties, express or implied, including but not limited to, implied warranties as to the merchantability and fitness for a particular purpose of the Portal, or any information which is on it or referred to in it, from time to time.

7.3 The Authority will not be liable (to the full extent that the law allows) for any damages of any kind arising from Your use of the Portal, including but not limited to direct, indirect, incidental, punitive, and consequential damages arising from any interruption temporary or otherwise in the availability of the Portal, accessibility of the Portal, loss or damage to equipment and software or non-configuration of data.

7.4 You shall indemnify the Authority (to the fullest extent that the law permits from time to time) from and against any legal liability which shall be suffered or incurred by the Authority at an time as a direct or indirect result of your access to and use of the Portal, regardless of whether or not such use is compliant with these Conditions.

 

  1. Changes to Terms and Conditions

8.1 The Authority may revise or entirely replace these Conditions at any time and in any way as it considers appropriate in its absolute discretion, by amending this page. You are expected to check this page from time to time to take notice of any changes which have been made.

 

  1. Complaints and Disputes

9.1 Any complaint or dispute about Your access to and/or use of the Portal shall be subject to the Authority’s corporate complaints procedure and/or (at the Authority’s discretion) formal mediation.

 

  1. Governing Law

10.1 Subject to point 9.1 above, these Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
